Terms of use
ARTICLE 1 - PURPOSE
1.1
The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of Goods (hereinafter the "Goods") and services offered by TJMAX to the Buyer (hereinafter the "Buyer").
1.2
By placing an order, Buyer accepts these Terms and Conditions without reservation and they shall prevail over any other document, including, without limitation, any contrary stipulation on a purchase order or other document issued by Buyer. These terms and conditions, together with the purchase order and any other agreement between TJMAX and Buyer, constitute the "Agreement" for the purposes hereof.
ARTICLE 2 - ORDERING
2.1
The Buyer places his order on line after having consulted the catalog which is at his disposal.
2.2
For the order to be validated, the Buyer must accept the present general conditions by clicking on the place indicated on the site. He will also have to choose the delivery address and method, the billing address, validate the payment method and pay online.
2.3
The order will be confirmed by e-mail at the latest at the time of delivery.
2.4
Any order implies acceptance of the prices and descriptions of the Goods available for sale.
2.5
In case of unavailability of the Goods, the Buyer will be informed as soon as possible and will also have the possibility to cancel his order. The Buyer will then have the choice of requesting either a refund of the sums paid within 30 days at the latest of their payment, or an exchange of the product.
2.6
For any question relating to the follow-up of an order, the Purchaser must call 01.48.63.93.38 (from Monday to Friday from 10:00 am to 6:00 pm, cost of a local call).
ARTICLE 3 - PRICES
3.1
TJMAX reserves the right to modify its prices at any time but undertakes to apply the prices in force at the time of the order, subject to availability on that date.
3.2
The prices are indicated in euros. They do not take into account the delivery costs, invoiced in supplement, and indicated before the validation of the order. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will automatically be reflected in the price of the products in the online store.
3.3
The payment of the totality of the price must be realized at the time of the order. At no time, the paid sums could be regarded as deposits or installments.
ARTICLE 4 - METHOD OF PAYMENT
4.1
In order to pay for the order, the Customer has the choice of all the payment methods made available by TJMAX, namely :Visa, Mastercard, CB, and Paypal.
4.2
The Customer guarantees TJMAX that he/she has the necessary authorizations to use the payment method chosen by him/her when validating the order form.
ARTICLE 5 - DELIVERY AND RECEIPT OF GOODS
5.1
No deliveries will be made to campgrounds, hotels, post office boxes or leftovers. The Goods are delivered to the address indicated by the Buyer on the order form who must ensure its accuracy. Any package returned to TJMAX because of an incorrect or incomplete delivery address will be reshipped at the Customer's expense.
5.2
Receipt: In the event of damage or non-conformity of the delivered Goods, it is the Buyer's responsibility to make all necessary reservations within 20 days of receipt by e-mail to the following address: [email protected] or on plain paper to TJMAX at the following address TJMAX, Paris Nord 2, 290 rue de la Belle Étoile, Roissy en France, 95934 Roissy Charles de Gaulle Cedex. Failing this, the Goods shall be deemed to have been accepted as conforming and in perfect condition.
5.3
It is the responsibility of the Buyer who wishes to return the Goods for an exchange or refund to send them within 20 days of their delivery to the following address TJMAX, Paris Nord 2, 290 rue de la Belle Étoile, Roissy en France, 95934 Roissy Charles de Gaulle Cedex. The goods must be unworn, unwashed and in perfect condition for resale, with the labels and in the original packaging. The Customer must also attach the invoice (or a copy) as well as the reason for the return on plain paper. Upon receipt, TJMAX will replace the Goods or refund the purchase price if they are in perfect condition as specified.
5.4
The consumer may bring an action, at his choice, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, before the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.
ARTICLE 6 - GUARANTEE OF THE GOODS
6.1
TJMAX guarantees the Customer against all consequences of hidden defects of the sold goods in accordance with the legal texts in force.
6.2
The Customer is expressly informed that TJMAX is not the producer of the Goods within the meaning of articles 1386-1 et seq. of the Civil Code relating to liability for defective products.
ARTICLE 7 - FORCE MAJEURE
7.1
TJMAX shall be relieved of all liability in the event of Force Majeure. In this context, "Force Majeure" means any event or condition beyond TJMAX's reasonable control that prevents it from performing its obligations in whole or in part, including but not limited to decisions of a public authority, fire, strikes, shortage of raw materials and loss of export permits, etc.
ARTICLE 8 - PROCESSING OF PERSONAL DATA
8.1
TJMAX undertakes to comply with the legislation applicable to the protection of personal data in accordance with the Data Protection Act.
ARTICLE 9 - PARTIAL NON-VALIDATION
9.1
If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a definitive decision of a competent jurisdiction, the other stipulations will keep all their force and their scope.
SECTION 10 - NON-WAIVER
10.1
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these terms and conditions shall not be construed for the future as a waiver of the obligation in question.
ARTICLE 11 - TITLE
11.1
In the event of any difficulty of interpretation between any of the titles appearing at the head of the clauses, and any of the clauses, the titles will be declared non-existent.
ARTICLE 12 - APPLICABLE LAW
12.1
The present general conditions are subject to the application of French law.
ARTICLE 13 - CONDITIONS FOR RETURNS AND EXCHANGES
To be returned, items must be returned in their original condition. Items must not have been worn or washed and must be in resalable condition.
Returned or exchanged items must be accompanied by the tags, as well as any corresponding accessories and user manuals. No refunds or exchanges will be made for incomplete, damaged or soiled returns.
Exchanges:
Please return the item(s) following the return procedure as explained in the previous section.
Please indicate on the return form the item(s) to be exchanged, the reason for the exchange, and the color and size of the new item requested. Then include the completed return form inside the package containing the returned item.
Availability of the requested replacement item cannot be guaranteed. Your replacement order will be sent to you with the same delivery method as your original order. Shipping costs for the replacement order will be charged to Project X Paris.
Once the exchange procedure is finalized, you will receive an email notification.
Refunds :
We will refund the original price paid for the returned item.
The total amount of the returns will be credited to the buyer's original method of payment. The buyer's original credit card will be credited at the time of processing the returned items and the credit will appear on the customer's next bank statement.
Original shipping charges are non-refundable, with the exception of cancellations by seller.
Once the refund process is finalized, you will receive an email notification.
