Terms of use

ARTICLE 1 - PURPOSE

1.1 The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of Goods (hereinafter the "Goods") and services offered by TJMAX to the Purchaser (hereinafter the "Purchaser").

1.2 Any order implies the Buyer's unreserved acceptance of these General Terms and Conditions of Sale, which shall prevail over any other document, including in particular any stipulation to the contrary on a purchase order or other document issued by the Buyer. Together with the purchase order and, if applicable, any other agreement between TJMAX and the Buyer, they constitute the "Contract" for the purposes hereof.

ARTICLE 2 - ORDERING

2.1 The Buyer places an order online after consulting the catalog.

2.2 For the order to be validated, the Buyer must accept these terms and conditions by clicking where indicated on the site. He/she must also choose the delivery address and method, the billing address, validate the payment method and pay online.

2.3 The order will be confirmed by e-mail at the latest at the time of delivery.

2.4 Any order implies acceptance of the prices and descriptions of the Goods available for sale.

2.5 In the event of unavailability of the Goods, the Buyer will be informed as soon as possible and will also have the option of cancelling the order. The Buyer will then have the choice of requesting either a refund of the sums paid within 30 days of their payment, or an exchange of the product.

2.6 For any question relating to the follow-up of an order, the Buyer should call +33 1 76 39 01 58 (Monday to Friday, 9am to 6pm, cost of a local call).

ARTICLE 3 - PRICES

3.1 TJMAX reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of the order, subject to availability on that date.

3.2 Prices are given in euros. They do not include delivery charges, which are invoiced in addition and indicated before the order is validated. Prices take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store.

3.3 Payment in full must be made at the time of ordering. At no time may the sums paid be considered as deposits or advance payments.

ARTICLE 4 - METHOD OF PAYMENT

4.1 To pay for his/her order, the Buyer has the choice of all the payment methods made available by TJMAX, namely : Visa, Mastercard, CB, and Paypal.

4.2 The Customer guarantees TJMAX that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order form.

ARTICLE 5 - DELIVERY AND ACCEPTANCE OF GOODS

5.1 No deliveries are made to campsites, hotels, poste restante or post office boxes. The Goods are delivered to the address indicated by the Purchaser on the order form, who must ensure its accuracy. Any package returned to TJMAX because of an incorrect or incomplete delivery address will be reshipped at the Buyer's expense.

5.2 Receipt: In the event of damage or non-conformity of the delivered Goods, it is the Buyer's responsibility to make all necessary reservations within 15 days of receipt by e-mail to the following address: [email protected] or on plain paper to TJMAX at the following address: TJMAX LOUVRES, ZAC de la Butte aux Bergers, 9 avenue du Noyer à la Malice, Bâtiment A1 95380 LOUVRES. Failing this, the Goods shall be deemed to have been accepted as conforming and in perfect condition.

5.3 It is the responsibility of the Buyer who wishes to return the Goods for an exchange or refund to send them within 15 days of delivery to the following address: TJMAX LOUVRES, ZAC de la Butte aux Bergers, 9 avenue du Noyer à la Malice, Bâtiment A1 95380 LOUVRES. Goods must be unworn, unwashed and in perfect condition for resale, with labels and in the original packaging. The Customer should also enclose the invoice (or a copy) and the reason for the return on plain paper. Upon receipt, TJMAX will replace the Goods or refund the purchase price if they are in perfect condition as specified.

5.4 In addition to one of the courts having territorial jurisdiction under the Code of Civil Procedure, the consumer may choose to bring the matter before the court for the place where he resided at the time the contract was concluded or at the time the harmful event occurred.

ARTICLE 6 - GOODS WARRANTY

6.1 TJMAX guarantees the Customer against all consequences of latent defects in the goods sold in accordance with the legal texts in force.

6.2 The Customer is expressly informed that TJMAX is not the producer of the Goods within the meaning of Articles 1386-1 et seq. of the French Civil Code relating to liability for defective products.

ARTICLE 7 - FORCE MAJEURE

7.1 TJMAX shall be relieved of all liability in the event of Force Majeure. In this context, "Force Majeure" means any event or condition beyond TJMAX's reasonable control which prevents all or part of TJMAX's performance of its obligations, including, but not limited to, decisions of a public authority, fire, strikes, shortage of raw materials and loss of export permits, etc.

ARTICLE 8 - PROCESSING OF PERSONAL DATA

8.1 TJMAX undertakes to comply with the legislation applicable to the protection of personal data in accordance with the French Data Protection Act.

ARTICLE 9 - PARTIAL NON-VALIDATION

9.1 If one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

ARTICLE 10 - NON-WAIVER

10.1 The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions shall not be interpreted for the future as a waiver of the obligation in question.

ARTICLE 11 - TITLE

11.1 In the event of any difficulty of interpretation between any of the headings appearing at the top of the clauses and any of the clauses, the headings will be declared non-existent.

ARTICLE 12 - APPLICABLE LAW

12.1 These terms and conditions are governed by French law.

ARTICLE 13 - CONDITIONS GOVERNING RETURNS

Items must be returned in their original condition. Items must not have been worn or washed, and must be in a condition suitable for resale. Returned items must be accompanied by all labels, accessories and user manuals. No refunds will be made if returned items are incomplete, damaged or soiled.

A credit note will be issued automatically and will be available in the Credit notes and vouchers section of your customer account upon receipt of your parcel (subject to compliance with the return conditions specified above).

An e-mail will be sent to inform you of this.

In both cases, this credit is valid for 1 year from receipt of the e-mail and can be combined with current offers and gift cards Project X Paris.

If, however, you would like a refund, simply reply to the e-mail I would like a refund.

The refund will be made directly to the payment method used for the order.

GENERAL TERMS AND CONDITIONS OF SALE ALMA

  • The Vendor offers its customers Alma's credit service for the settlement of their purchases and the execution of payment. This is subject to the Customer's acceptance of the GCU or of the credit agreement proposed by Alma.
  • If Alma refuses to grant credit for an order, the order may be cancelled.
  • Any termination of the General Terms and Conditions between the Customer and the Seller shall result in the termination of the General Terms and Conditions or the credit agreement between Alma and the Customer.
  • Payment in three or four instalments is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
  • Purchase amount:
  • Only purchases between €100 and €2000 are eligible for payment with Alma.
  • Fees: By paying in instalments with Alma, the Customer does not pay any fees.
  • Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
  • Termination: Any termination of the General Terms and Conditions between the Seller and the customer will result in the termination of the General Terms and Conditions between Alma and the customer.

In addition, only for payments in 5 or more instalments (e.g. 10 instalments),also add toyour general terms and conditions of sale ( in accordance withArticle L312-45, under penalty of fine):

  • The amount is paid by a credit facility granted by Alma SAS, listed on the REGAFI under number 90876.
  • Payment: Payment by credit is available for the settlement of their purchases via our partner Alma, the execution of the payment is conditioned by the signature of the credit contract proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with Article L312-46 of the French Consumer Code. If Alma agrees to grant credit to the customer, the amount will be paid by credit in accordance with article L312-45 of the French Consumer Code. Any refusal by Alma to grant credit for an order may result in its cancellation, unless the customer agrees to pay cash. Any termination of the General Terms and Conditions binding the Vendor and the customer will result in the termination of the credit contract between Alma and the customer. In the event of withdrawal, the costs and interest incurred by the customer will be reimbursed in accordance with regulations.
  • Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a tele-payment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
  • Special case: In the case of a contract for the sale or provision of services to be performed successively or delivered over a long period of time, the Seller must specify in its GTCS the time at which delivery or provision will begin.
