Terms of Use ARTICLE 1 - PURPOSE 1.1 These general conditions aim to define the rights and obligations of the parties in the context of the online sale of Goods (hereinafter the "Goods") and services offered by TJMAX to the Buyer (hereinafter the "Buyer"). 1.2 Any order implies the unconditional acceptance by the Buyer of these General Terms and Conditions of Sale, which prevail over any other document, including any contrary provision on an order form or other document issued by the Buyer. These, together with the order form and, if applicable, any other agreement between TJMAX and the Buyer, constitute for the purposes hereof the "Contract". ARTICLE 2 - ORDER 2.1 The Buyer places their order online after consulting the catalog available to them. 2.2 For the order to be validated, the Buyer must accept these general conditions by clicking in the indicated place on the site. They must also choose the delivery address and method, the billing address, validate the payment method, and pay online. 2.3 The order will be confirmed by email no later than at the time of delivery. 2.4 Any order implies acceptance of the prices and descriptions of the Goods available for sale. 2.5 In case of unavailability of the Goods, the Buyer will be informed as soon as possible and will also have the option to cancel their order. The Buyer will then have the choice to request either a refund of the amounts paid within 30 days at the latest from their payment, or an exchange of the product. 2.6 For any question regarding order tracking, the Buyer must call +33 1 76 39 01 58 (Monday to Friday from 9 am to 6 pm, local call cost). ARTICLE 3 - PRICE 3.1 TJMAX reserves the right to modify its prices at any time but commits to applying the rates in effect indicated at the time of the order, subject to availability on that date. 3.2 Prices are indicated in euros. They do not include delivery charges, which are invoiced additionally and indicated before order validation. Prices include the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store. 3.3 Full payment must be made at the time of the order. At no time can the amounts paid be considered as deposits or down payments. ARTICLE 4 - PAYMENT METHOD 4.1 To pay for their order, the Buyer has the choice of all payment methods made available by TJMAX, namely: Visa, Mastercard, CB, and Paypal. 4.2 The Buyer guarantees TJMAX that they have any necessary authorizations to use the chosen payment method at the time of order validation. ARTICLE 5 - DELIVERY AND RECEIPT OF GOODS 5.1 No delivery is made to campsites, hotels, poste restante, or PO boxes. Goods are delivered to the address indicated by the Buyer on the order form, who must ensure its accuracy. Any package returned to TJMAX due to an incorrect or incomplete delivery address will be resent at the Buyer’s expense. 5.2 Receipt: It is the Buyer's responsibility, in case of damage or non-compliance of the delivered Goods, to make all necessary reservations within 15 days of receipt by email to the following address: support@projectxparis.fr or on free paper to TJMAX at the following address: TJMAX, 28 Avenue de la Demi Lune 95700 Roissy en France. Otherwise, the Goods are deemed to have been accepted as compliant and in perfect condition. 5.3 It is the Buyer's responsibility who wishes to return the Goods to obtain an exchange or refund to send them within 15 days following their delivery to the following address: TJMAX, 28 Avenue de la Demi Lune 95700 Roissy en France. The goods must be unworn, unwashed, and in perfect resale condition, with tags and in the original packaging. The Buyer must also enclose the invoice (or a copy) as well as the reason for the return on free paper. Upon receipt, TJMAX will replace the Goods or refund the purchase price if they are in perfect condition as specified. 5.4 The consumer may choose to bring an action, in addition to one of the territorially competent courts under the Code of Civil Procedure, before the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event. ARTICLE 6 - WARRANTY OF GOODS 6.1 TJMAX guarantees the Buyer against all consequences of hidden defects of the goods sold in accordance with the applicable legal provisions. 6.2 The Buyer is expressly informed that TJMAX is not the producer of the Goods within the meaning of articles 1386-1 and following of the Civil Code relating to liability for defective products. ARTICLE 7 - FORCE MAJEURE 7.1 TJMAX shall be released from all liability in case of Force Majeure. In this context, "Force Majeure" means any event or condition that is not reasonably under its control and which prevents in whole or in part the performance of its obligations, including notably decisions of a public authority, fire, strikes, raw material shortages, and loss of export permits, etc. ARTICLE 8 - PROCESSING OF PERSONAL DATA 8.1 TJMAX undertakes to comply with the legislation applicable to the protection of personal data in accordance with the Data Protection Act. ARTICLE 9 - PARTIAL INVALIDITY 9.1 If one or more provisions of these general conditions are held to be invalid or declared as such pursuant to a law, regulation, or following a final decision of a competent court, the other provisions shall retain their full force and effect. ARTICLE 10 - NO WAIVER 10.1 The fact that one party does not invoke a breach by the other party of any of the obligations set forth in these general conditions shall not be interpreted in the future as a waiver of the obligation in question. ARTICLE 11 - HEADINGS 11.1 In case of difficulty in interpretation between any of the headings at the beginning of the clauses and any of the clauses, the headings shall be declared non-existent. ARTICLE 12 - APPLICABLE LAW 12.1 These general conditions are subject to French law. ARTICLE 13 - RETURN CONDITIONS To be eligible for a return, items must be returned in their original condition. Items must not have been worn or washed and must be in a condition suitable for resale. Returned items must be accompanied by tags, as well as any corresponding accessories and user manuals. No refund will be made if the returned items are incomplete, damaged, or soiled. A credit note will be automatically issued and will be available in the Credits and discount vouchers section of your customer account upon receipt of your package (subject to compliance with the return conditions specified above). An email will be sent to inform you. In both cases mentioned, this credit note is valid for 1 year from receipt of the email and can be combined with current offers as well as Project X Paris gift cards. However, if you wish for a refund, simply reply to the email with I wish a refund. The refund will be made directly to the payment method used during the order.
